General Terms and Conditions
Your contract – Your contract for your package is with FOODIE CYCLING SL, Address: Calle Son Armadans 23, Bajos B Palma de Mallorca 07014. Registered Travel Agency in the Balearic Islands, number AVBAL/822
Alterations to Itinerary – We aim to ensure that none of the elements of your holiday arrangements are altered. Our itineraries are put forward as a statement of intention only, not as representations or undertakings that they will be carried out. However, there may be occasions when we cannot follow our advertised itineraries, or schedules. If any additional expenses are incurred as a result of delays, accidents or disruptions of planned itineraries beyond our control, e.g. strikes, natural disasters, fire, technical problems of transport, cancellations or changes of schedule by airlines, or similar events out of our control, any such expenses are to be borne by the guests.
Force Majeure – Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in questions could not, even with all due care, foresee or avoid.
Complaints – If you have a complaint please notify and write in detail via email mar@foodiecycling.com
Jurisdiction – customers are subject to the jurisdiction of the courts and tribunals of Spain, renouncing their own judgement. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of Spain only.
Acknowledge of Responsibility and Liability
In participating in a tour organised by the Organiser, Foodie Cycling, I understand and agree the following:
I am required to follow all instructions from the organiser, its employees or agents. I Understand that if I fail to comply with these instructions, the Organiser reserves the right to suspend my involvement in the Event and that I shall not be entitle to any refund of any amounts I have paid to the Organiser for participating in the Event in such circumstances.
I am physically capable of participating in this organised cycle tour, which will involve strenuous physical activity. I have provided accurate information to the Organiser about my health, fitness and cycling experience. I am sufficiently fit and have no additional medical conditions that will be exacerbated by such activity.
I will be cycling on public roads and in mountainous areas, this is an activity with a danger of personal injury and even death. I accept such risk and will be responsible for my own actions and involvement in this activity. I agree that the Organiser, its employees and agents are released from any liability resulting from my injury or death or any loss of or damage to my property suffered during the Event.
I am responsible for the condition and maintenance of the bike I use on the Tour and any other equipment I bring to or use on the Tour. The Organiser gives no guarantee or warranty in respect of any maintenance or repairs carried out at my request on any bike or other equipment. The Organiser will not be liable for any damage to my property as a result of any maintenance or repairs carried out at my request on any bike or other equipment.
I acknowledge that the rental bikes provided have no insurance against theft and I will be responsible to cover the full cost of any bike that gets stolen or go missing for the duration of my trip with the organiser. I acknowledge that all the information provided in this document and in all the communication with Foodie Cycling and any of its representatives is owned by the company and it’s only to be used by the participants and only during the duration of this package. Any unauthorized distribution of any of this information is illegal I acknowledge it is my responsibility to bring my European Insurance Card and take out my own travel insurance. This should cover the cost of medical treatments, evacuation, repatriation, loos of earnings / cost of care in the event of illness or injury during the holiday.
I should also cover loss or damage to property (including your bicycle / hired bicycle), third party liability and your cancellation of the holiday.

Deposit and Payments

A deposit of 350€ is required for confirming this package. I understand this amount covers registration and insurance for the race and all administration costs. I understand this amount is non-refundable and will be deducted from my final payment.
A deposit of 50% of the total cost is required before November 15th 2022 Payment of the deposit constitutes acceptance of the Terms and Conditions.
Final payment is required by January 16th 2023. Failure of completing the payment by this date will mean you are no longer interested, and your space will be given to the next person on waiting list.

Cancellation Policy
All cancellations have to be made in writing and sent by email on hola@foodiecycling.com Cancellation assessments will be calculated on the day Foodie Cycling receives your notification. If cancelling the following policy will apply:
• Up to January 15th 2023: 100% of the money received will be refunded. Except for the 350€ that are non-refundable.
• From January 16th 2023 onwards: Cancellation charge of 100% of the total cost of the tour.
